California Physician Fraud: When Will They Ever Learn? Not Any Time Soon

(What follows is an update of a story we originally published 2 years ago this month):

medi-fraud-artDoctor Emilio Louis Cruz, age 61 of Carson California, was sentenced by United States District Judge Morrison England to 3 years in prison. He was also ordered to pay $600,000 in restitution, for his role in a Medicare Fraud Conspiracy. This, according to U.S. Attorney Benjamin B. Wagner.

Court records show that Cruz, a neurology specialist, acquired his medical degree at Yale University. He held medical licenses in 3 states. According to his testimony at the trial of Cruz’s co-defendants – Doctors Ramanathan Prakash, Alexander Popov, and Lana LeChabrier – a man named Vardges Egiazarian owned 3 health care clinics in Sacramento, Richmond, and Carmichael California. Cruz operated the Carmichael clinic. He established a Medicare provider number for the clinic and set up a bank account into which Medicare funds were deposited. Hundreds of medical bills were submitted to Medicare seeking reimbursement for services. The FBI found this extremely interesting, since Cruz never treated a single patient.

During most of the time that the Carmichael clinic operated, Cruz was living and working in North Dakota. A similar pattern was followed at the other two clinics operated by Egiazarian, and not one of the physicians submitting bills to Medicare ever treated a single patient.

The clinics’ patients were primarily Hispanic who spoke no English. They were recruited and transported to the clinics by van drivers who were paid according to the number of patients they brought in. Rather than being charged a co-payment, the patients were paid for their time – generally $100 per visit – in exchange for their Medicare number. Fake medical charts were created, stating that each patient received comprehensive exams and a broad array of diagnostic tests. Few of these tests were ever performed, and none were performed based on any medical need. Clinic staff filled out other portions of the charts using imaginary information. Some clinic employees admitted to performing various tests on themselves, and placing the results into patient files.

In all, the 3 clinics billed more than $5,000,000 in fraudulent claims to Medicare – $1,700,000 of which was actually paid. With respect to claims submitted for services by Cruz at the Carmichael clinic, Medicare paid $601,581 based upon fake billing by him.

Doctors Prakash, Popov, and LeChabrier, were also found guilty by a jury on July 8, 2011, of Conspiracy to Commit Healthcare Fraud and various other charges of Healthcare Fraud.

Here is a list of those involved in this massive medical system theft case:

  • Doctor Ramanathan Prakash – currently serving 10 years in federal prison
  • Doctor Lana LeChabrier – currently serving 6 years in prison
  • Doctor Alexander Popov – currently serving 8 years
  • Doctor Derrick Johnson – pleaded guilty and is awaiting sentencing
  • Nazaret Salmanyan, an unlicensed ultrasound technician – sentenced to 20 months
  • Zoya Belov, a nurse licensed in Russia but not here – pleaded guilty and is awaiting sentencing
  • Jenny Saechao, recruited patients, pleaded guilty, and is awaiting sentencing
  • Migran Petrosyan, a co-owner of the Richmond clinic –pleaded guilty and was sentenced to 27 months
  • Shushanik Martirosyan, a medical biller who submitted fake claims to Medicare for all 3 clinics – pleaded guilty and was sentenced to 18 months

Incidentally, all of the above felons except one are criminal immigrants.

Paramedic Heretic’s Advice to President Trump: Forget Non-Criminals. Just Toss Out the Doctor Perverts

Any chance this Third World Assassin will be deported? Don’t be ridiculous. The U.S. doesn’t deport criminal immigrant doctors. We reward them with a fresh license in a new state. Cool, huh?

If America’s newest President really wanted to impact this country’s immigration soap opera in a meaningful way, he might start taking baby steps that DON’T result in angry protest marches. And one thing both liberal and conservative folks might agree on, is bad doctors. Do we really need MORE of them?

All Mr. Trump would have to do to please the masses – and protect the citizenry -is focus on immigrant perverts. Our advice to the President? Forget the immigration ban as you currently propose.

Just kick out immigrant predators. God knows there are plenty of these sexually-repressed fools around. Just ask us. We’ll send you our list of 400 today. Simple as soup.

Last week in northern New Jersey, a foreign-born MD got a slap on the degreed butt for sexually assaulting 8 women – EIGHT –  who had either worked as staff members, or who came to him for medical care at his Bergenfield clinic.

Question: Do you suppose you’d get maybe a week or two in jail, if you committed 8 sexual assaults? You bet your sweet bippy you would.

Doctor Raja Jagtiani, a 55-year-old Indian, appeared before Superior Court Judge Margaret Foti. They say he kept covering his face with his hands during the trial.

At the end of the trial, prosecutor Kristin DeMarco read a victim impact statement by one victim, who had been a patient for years. She revealed that when she arrived for her appointment one day, Jagtiani directed her to his private office, instead of an exam room. Once the door was closed, he reached inside her blouse and grabbed her breasts.

The victim’s story was similar to those of at least 3 other women who were medical staff in Jagtiani’s clinic, between 2009-2015. They related additional incidents when the freaky doctor either forced himself on them sexually, kissed or bit them on the face. The harassed employees described “touching, grabbing my legs and waist on many occasions.”

Another victim described the doctor rubbing up against her, sexually gratifying himself while grabbing her breasts.

And why? Because he wore a lab coat and he wanted to. Get it?

Before the trial, the New Jersey Board of Medical Examiners at least had the good sense to jerk this idiot’s medical license for 10 years, after studying his criminal acts. You would be amazed how many medical boards don’t even do that much. It drives medical boards crazy when they have to discipline doctors because, well, they happen to be doctors, too.

Jagtiani eventually confessed that he had groped all 8 women. He was then sentenced to 5 years of probation. In other words, the legal system sent him to his room like a bratty 5th grader, which is, by the way, the usual punishment for lab coat felons.

“Doctor Jagtiani was suffering from depression when he touched the women. He has paid a heavy price and will continue to pay a heavy price – rightfully so. He is truly sorry.” (Defense attorney Aidan O’Connor)

Well, if he’s sorry . . . . 

So how about it, Mr. Trump? Why not start your Presidency with a step we can ALL get behind? Simple patient safety. No need to take our word for it: just cruise across town in the presidential “Beast” limousine for a nice little visit with the folks at Public Citizen.

The woman frowns and says, “I don’t think I’m supposed to. I’m his aunt.”

It’s been 3 years since 38-year-old Samira Frasch was found lying on the bottom of her swimming pool at her Tallahassee home. She had a serious bump on her head, water in her lungs and she was quite dead.

And yesterday, a Leon County Court jury found Doctor Adam Frasch guilty of her murder.

This particular Florida legal drama, presided over by no-nonsense Judge James Hankinson, played out on nationwide news coverage and attracted the viewership of countless thousands.

The trial had all the trappings of a hit TV show: strippers and violence, high society misbehavior and a lifeless, nude , former model in a swimming pool.

According to a Tallahassee Jury, It Was Doctor Adam Frasch

 

Frasch, age 49, was well-known in the Tallahassee area as a playboy foot specialist, with a hot temper and a quick zipper. He also had a curiously lucrative medical practice (he owned 14 high performance automobiles, for one thing) just across the state line in Thomasville, Georgia. At least U.S. government agents thought his shenanigans were curious: they had raided his clinic well before the murder arrest.

Samira was Frasch’ third wife, a former model born and raised on the African island of Madagascar. She had met Frasch in the summer of 2006 in France. They married in 2009. When she was able to move to Florida in 2010 she discovered her new husband was married when she met him, and had fathered a child with yet another woman since their engagement.

According to neighbors and friends, the discovery of his infidelities ignited a volatile relationship that extended through their divorce and eventually up to her death.

Throughout the trial, horny-toad Frasch maintained his innocence, although he admitted on the night of her death they’d had a champagne-fueled fight. That was understandable: she had just learned of yet another affair – this time with a stripper in Panama City.

When the doctor was arrested at his home in Panama City Beach hours after her body was discovered, police said he looked like he was packing to flee the country.

Frasch’s lawyer, Clyde Taylor, told the jury that the evidence of the doctor’s guilt was based entirely on circumstance. He argued that Samira was alive for hours after her ex-husband was seen leaving the house.

Paramedics testified that the victim appeared recently drowned. She did not look as though she’d been under water very long at all.

Samira’s autopsy revealed she died as a combined result of head trauma followed by drowning. The right side of her head showed a depressed skull fracture.

The prosecution merely repeated the following during final summation:

When Frasch was first arrested, he made two very strange statements to police:

“I loved Samira to death. I loved her to death.”

Gosnell: How Healthcare Breeds & Feeds Your Neighborhood Medical Monster

Kermit Gosnell is not our only physician serial-killer. He’s just the most recent

Serial-killer Doctor Kermit Gosnell started his life sentence in Pennsylvania State Prison almost exactly 3 years ago. We’re guessing you missed the story.

The unspeakable ugliness of the Doctor Kermit Gosnell grand jury report is a damning indictment of America’s healthcare system refusal to mete out appropriate physician discipline.  And when medical authorities deliberately ignore murderers, how surprising is it really, that innocent people die?

Of course the news media – many of whom hold a partisan liberal agenda in lieu of an ethical, neutral voice? Well, they look the other way too, don’t they?

And that kills people, too.

The jaw-dropping case of serial-killer Gosnell concerns a physician who routinely murdered babies and put their mothers through appalling and unnecessary danger and pain. Over the course of decades, Gosnell and his staff shockingly –and on a daily basis – would deliver live babies in the third trimester of pregnancy – and then kill these newborns by cutting their spinal cords with scissors.

Like we say, ugly.

Philadelphia’s House of Horrors. The hospitals knew. The State Medical Board knew. Physicians all over town knew, too. They all ignored the medical carnage

Gosnell’s so-called “clinic’ in Philadelphia was – without exaggeration – a house of horrors, carrying out their deadly business by overdosing pregnant women with dangerous drugs; spreading venereal disease among them with filthy instruments, carelessly puncturing their uteri and bowels – and sometimes killing the mothers while in the process of killing their babies.

Gosnell was eventually convicted on just 3 counts of First Degree Murder, even though those familiar with case agree he and his staff probably killed 500 children. The trial testimony was as grisly as anything ever revealed in an American courtroom. One witness – an unlicensed medical staff member – gave graphic testimony about the filthy conditions at the ‘clinic’ where he helped perform late-term abortions. Stephen Massof described how he snipped the spinal cords of babies, calling it, “literally a beheading. It is separating the brain from the body.” He testified that at times, when women were given medicine to speed up their deliveries, “it would rain fetuses. Fetuses and blood all over the place.”

One former staff member described hearing a baby screaming after it was delivered during an abortion procedure. “It sounded like a little alien.”

When authorities were unable to ignore the reports they had received for years, stunned investigators eventually discovered dozens of jars of baby feet, cut off and stored in the refrigerator that also held the medical staff’s lunches.

What? Are you saying that you never heard any of this?

Of course you didn’t. The press barely covered this story at all. Typical citizens, even today, when asked about the identity of Kermit Gosnell, would likely think something along the lines of a Muppet character.

It was almost exactly 7 years ago – in February 2010 – when an FBI team raided Gosnell’s gory kill-mill, euphemistically misnamed the Women’s Medical Society. Law enforcement at that time were simply looking for evidence that the clinic was illegally selling prescription drugs. Upon entering the building they were speechless.

Not ONE medical professional had ever bothered to tell law enforcement what was really going on. 

“There was blood on the floor. A stench of urine filled the air. There was cat feces on the stairs. Barely-conscious women scheduled for abortions were moaning in the waiting room, where they sat on dirty chairs, covered with blood-stained blankets. All of them had been sedated by unlicensed staff.”

FBI investigators were horrified at what the found

In the surgery rooms, Instruments were not sterile. Equipment was rusty and outdated. Oxygen equipment was covered with dust and had never been inspected. Dirty suction tubing used for abortions was also used for patients’ mouths.”

“Fetal remains, incredibly, were stored everywhere: in bags, milk jugs, orange juice cartons, and even in cat-food containers.”

Most MDs will not perform abortions after 5 months, and abortions after 6 months are illegal. Yet former employee Steven Massof estimated that nearly half of the second-trimester abortions performed by Gosnell, were beyond 6 months in gestational age. “Gosnell performed at least 4-5 illegal abortions every week.”

Now, whether you are pro- or anti-abortion, facts are facts. And when you perform late-term ‘abortions’ by inducing labor, what you are doing is delivering babies: live, breathing, wiggling children. By 6 months, most premies will survive if they are cared for. But that was not what the Women’s Medical Society was about. Gosnell had a simple solution for the unwanted infants he delivered: he killed them.

Of course Gosnell didn’t call it murder. He called it “ensuring fetal demise.” The way he guaranteed fetal demise was by stabbing scissors into the back of the babies’ necks and cutting the spinal cords. He called it “snipping.”

“Their little screams could be heard all over the clinic.”

And they did hundreds of “snippings”, mainly later at night. When Gosnell was unavailable, the “snipping” was done by one of his pretend doctors, or even by a secretary. The staff members acted as if it wasn’t murder at all because, well, the doctor said it wasn’t. And who among us puts a moral foot down in the presence of an MD?

Pretty much nobody.

 Few of his staff could ever be prosecuted, because Gosnell destroyed what few medical files he had bothered to write up. Among the relatively few cases that could be specifically documented, one was Baby Boy A. His 17-year-old mother was seven and a half months pregnant when labor was induced.  His birth weight was 6 pounds. He was breathing and moving when Gosnell cut his neck with scissors and plopped the  little body into a shoebox for disposal.

The doctor joked that this baby was so big he could “probably walk me to the bus stop.”

Another victim, Baby B: his little body was found frozen in a large water bottle, 7 months of gestational age.

Baby C was moving and breathing for 20 minutes, before a staff member walked in the room and cut the spinal cord, just the way she had seen Gosnell do it so many times.

Like medical staff the world over, they did whatever they were told.

Now, it’s perfectly reasonable that you didn’t hear any of this. But in the state of Pennsylvania, authorities knew all about it. And they ignored it for years. Gosnell was a doctor, for God sakes. And in the U.S., we don’t discipline doctors until we are embarrassed into doing . . . well, something.

The Failure to Stop the Madness

How in the world did this go on for so long without anyone stopping it? The grand jury asked that very question in their report. Because every state has multiple oversight agencies, Pennsylvania’s authorities could have shut down Kermit Gosnell long ago.

But none of them did. In a normal world, the first line of defense would have been the Pennsylvania Department of Health. Their job is to ensure clinics follow rules and provide safe care. They had contact with the clinic as far back as 1979, but they never followed up.

Oh, they knew what was going on. Many violations were brought to their attention over the years, but Gosnell promised he’d correct them and that was that. He was, after all, a doctor.

Why would anybody actually drive across town and check?

But in 1993, the Pennsylvania Department of Health suddenly decided to accommodate liberal politicians and stop inspecting abortion clinics at all.  When lawyers representing injured women contacted them, the health department still didn’t send anyone over to look at the clinic. When a doctor from Children’s Hospital of Philadelphia hand-carried his letter of concern that Gosnell patients were coming in with the same venereal disease? No visit.

When the medical examiner of Delaware County told the state that Gosnell had performed an illegal abortion on a 14-year-old girl carrying a 7 month-old baby? Or when the department received official notice that a woman named Karnamaya Mongar had died by Gosnell’s careless surgery?

No visit by the state. No inspection. Nothing. The man wore a lab coat. He was untouchable.

Another agency with authority, the Pennsylvania Department of State, could have stopped Gosnell many years ago, too. The Department of State, through its Board of Medicine, licenses and oversees doctors. As far back as 2002, a Gosnell staff member secretly gave the Board of Medicine all the information they needed, detailing the garbage-level clinic: the unclean conditions; the unlicensed staff; the unsupervised drugging of patients; the teenage abortion patients; the narcotic pushing for resale on the street.  So the Board reluctantly assigned an investigator.

But the investigator never inspected the facility, questioned employees or reviewed any records. So the Board accepted his ridiculous ‘investigation’, and the complaint was dismissed. Not long after that, the Board received an even more disturbing report about patient Karnamaya Mongar, who died of infection after Gosnell punctured her uterus. The woman was 22 years old. A lawsuit against Gosnell was settled for nearly a million dollars, and the insurance company forwarded their investigation to the department.

That report should have been all the authorities needed. Instead, they ignored it. The same thing happened at least twice more: the Board received complaints about lawsuits against Gosnell, but ignored what was happening. Philadelphia Health Department staff once visited the Women’s Medical Society, inspecting the clinic in response to a report that dead fetuses were being stored in the employees’ lunch refrigerator. The inspection confirmed numerous violations. But no follow-up was ever done.

 A health department staff member once actually went to the clinic as part of a citywide vaccination program. She discovered that Gosnell was stealing from the program. This lady was the only employee – city or state – who actually tried to do something about the appalling things she saw there. She filed detailed reports identifying the worst violations of Gosnell’s practice. It should have been enough to stop him. Her reports were ignored.

The University of Pennsylvania Hospital, as well as Penn Presbyterian Medical Center, were near the clinic. They knew all about the house of horrors down the street. State law requires hospitals to report surgical complications from abortions. 10 years before, a Gosnell patient died in the ER after a careless abortion, and the hospital filed the legal report. Many other Gosnell patients were brought into Penn facilities for emergency, too. Yet other than the first report, Penn Medical Center could not show they had ever complied with the law, to alert authorities about a dangerous doctor. Not even when one of his patients was brought in by ambulance dead.

Then there is the National Abortion Federation. The Federation is a group of abortion providers who supposedly uphold health and legal standards for its members. Gosnell, strangely, applied for admission to the club. The membership evaluator from Federation clearly saw that medical records were not being kept; that abortion dangers were not explained; that patients were not monitored; that important equipment was not available; that drugs were misused. The  Women’s Medical Society was the worst abortion clinic she had ever inspected. She rejected Gosnell’s application, but she never told anyone in authority about all the terrible things she had seen.

So Why Haven’t You heard This Story?

Delivering babies and then cutting their heads off may be the worst of American reality. But here is the truly galling aspect of this case. Abortion is staunchly defended by the ‘progressive’ left, which in turn is staunchly supported by thousands of liberal news reporters. The last thing they want is oversight and regulation of abortion clinics. They want no discussion of the appropriateness of late-term abortions. They want no penalties for failing to report crimes, nor punishment for doctors killing babies.

Simply put, the liberal news writers – and their bosses – do not merely insist upon covering the news – they insist upon dictating what you should – and should not – know about controversial issues.

And the last thing they want the public to be knowledgeable about? The monstrous ugliness of baby murder mills, and the evil physicians who operate them for profit.

It’s just the worst of human behavior, ignored by medical/legal authorities; ignored by contemptible news generators with an agenda.
